1. This agreement
This site belongs to Bottega Bespoke LLC, a Florida limited liability company trading as Bottega Bespoke, at 135 San Lorenzo Ave, Suite 130, Coral Gables, Florida 33146. In these terms, "we", "us" and "our" mean Bottega Bespoke LLC, and "you" means the person using the site.
By using bottegabespoke.com you accept these terms. If you do not accept them, please do not use the site. Our Privacy Policy is part of this agreement.
2. What this site is
It is an introduction to the house and an invitation to visit. Nothing on it is an offer to sell, a quotation, or a promise of availability. Prices are not published here, because a bespoke garment is priced from the cloth, the make and the work it needs, and that conversation happens in the showroom.
We take care with what we publish. Fabrics run out, mills change their books, hours change, and photographs of cloth are photographs. Where colour, texture or availability matters, handle the cloth with us before you decide.
3. Appointments
Appointments requested through this site, through the booking widget, by telephone or by email are requests until we confirm them. We work with few clients at a time and the diary is often full.
If you cannot come, tell us as early as you can and we will move it. The courtesy costs you nothing and it releases a fitting hour for someone else. Any deposit, cancellation or rescheduling policy that applies to a particular commission will be told to you at the time and agreed with you directly.
4. Commissions and purchases
Nothing here forms a contract of sale. What we make for you, what it costs, when it will be ready, what happens if it is not right, and every other term of the work is agreed between you and us directly, in the showroom or in writing, and those terms govern the commission.
Bespoke garments are cut for one body. That is the point of them, and it is also why the terms of a commission are settled before the cloth is cut rather than found on a web page afterwards.
5. Email and text messages
When you write to us we reply. When you ask us to text you about an appointment, we do, on the terms set out in section 4 of the Privacy Policy: message frequency varies, message and data rates may apply, you may reply STOP at any time to stop them and HELP for help, and consent is never a condition of purchase.
6. How you may use the site
Read it, share it, come and see us. Please do not:
- copy, scrape or republish the photographs or the text for your own commercial use,
- use the contact form to send advertising, chain messages or anything unlawful,
- attempt to interfere with the site, its security, or the equipment it runs on,
- use any automated system to load the site at a rate a person could not,
- misrepresent yourself as us, or as connected with us.
We may block access to anyone who does any of the above, without notice.
7. What belongs to us
The name Bottega Bespoke, the mark, the wordmark, the photographs, the films, the text, the design and the code of this site are owned by us or licensed to us, and are protected by copyright and trade mark law. Nothing on this site grants you a licence to use any of it, except to view the site in the ordinary way and to share a link to it.
The mills, brands and third parties named on this site own their own marks. Naming them is a statement of fact about the cloth we buy, not a claim to their marks or a claim of endorsement by them.
8. What you send us
Personal information you send us is handled under the Privacy Policy. If instead you send us an idea, a suggestion or a comment about the house or the site, you agree that we may use it without obligation, payment or confidentiality. Please do not send us anything you consider confidential through the form.
9. Other companies' services
Booking runs on a third party system, and the site links to maps, to social media and to other sites. Those services are operated by other companies under their own terms and their own privacy policies. We do not control them, we do not endorse everything on them, and we are not responsible for them.
10. Accessibility
We built this site to be usable with a keyboard, with a screen reader, and with motion reduced. If something here got in your way, write to info@bottegabespoke.com and tell us what happened. We will fix it, and in the meantime we will help you by telephone or in person.
11. No warranty
The site is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the site will be uninterrupted, that it will be free of errors, or that it or the servers that carry it are free of harmful components.
This section is about the website. It does not limit anything we agree with you about a garment we make for you.
12. Limitation of liability
To the fullest extent permitted by law, neither Bottega Bespoke LLC nor its members, employees or suppliers will be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data or loss of goodwill, arising out of your use of this site, whether the claim is brought in contract, in tort or otherwise, and whether or not we were told such damages were possible.
Our total liability arising out of or relating to this site will not exceed one hundred United States dollars (US$100). Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so parts of this section may not apply to you.
13. Indemnity
You agree to indemnify and hold harmless Bottega Bespoke LLC and its members and employees from any claim, loss, liability or expense, including reasonable legal fees, arising out of your misuse of the site or your breach of these terms.
14. Governing law
These terms are governed by the laws of the State of Florida, without regard to its conflict of law rules. Any dispute arising out of them or out of your use of the site will be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to the jurisdiction of those courts.
If any part of these terms is held unenforceable, the rest stays in force. Our not enforcing a term on one occasion is not a waiver of it.
15. Changes
We may revise these terms. When we do, we will change the date at the top of this page, and the revised terms apply from the moment they are posted. Continuing to use the site after that means you accept them.
